The judgement stated that the care component of the Disability Living Allowance benefit could and should cover needs beyond a basic subsistence level. Lilley argued that the benefit should only cover essentials. The judges agreed with Becky Halliday, who wanted to pay for a sign language interpreter, that claimants should be able to live ‘reasonably’ and that a ‘reasonable’ lifestyle at least extended to paying for an interpreter.

For the last few years, the settlement forlocal government, announced annually in the Chancellor’s budget at the end of November, has been poor, necessitating annual reductions in expenditure. Few social services departments were able to avoid making large and damaging cuts in the late 1980s and this trend has intensified in the 1990s. For many authorities, cuts in the mid-1990s have been the most root and branch of all. Increases in demand at the same time as reductions in budgets drive down service levels and standards.

The legal battleground these days is as much about resources as professional issues. The last Conservative Government recognised this as early as 1992 when through the Social Services Inspectorate it wrote to all local authorities advising them not to place on record ‘unmet need’, in order to protect themselves from legal challenges if they couldn’t afford to pay for services.
